This Public Offer Agreement (Offer) is a public proposal by Sole Proprietor Bila Oksana Volodymyrivna (the “Seller”) to any interested party (the “Buyer”) to enter into a contract for the purchase and sale of goods remotely under the terms set forth herein, via the website zamkova-svitlana.com.
The Offer is addressed to an unlimited circle of persons. Acceptance (the “Acceptance”) occurs when the Buyer places an order on the website and the Seller confirms it. At that moment, the contract becomes legally binding.
1.1. Offer — a public proposal to conclude this Agreement on the terms contained herein.
1.2. Order — a request submitted by the Buyer via the website to purchase particular goods.
1.3. Goods — footwear or other items offered for sale on the Seller’s website.
1.4. Buyer — a person or entity that accepts the terms of this Offer and places an Order.
1.5. Acceptance — the full and unconditional acceptance of the Offer’s terms by placing an Order and receiving confirmation from the Seller.
2.1. The Seller undertakes to transfer the Goods selected by the Buyer, and the Buyer undertakes to pay and accept them under this Agreement.
2.2. The Agreement becomes effective upon Acceptance.
2.3. If after Order placement the Seller changes the price or shipping conditions, the Buyer may confirm or cancel the Order.
3.1. Prices are indicated in UAH and include VAT if mandated by law.
3.2. Payment methods include those provided by the Seller (bank transfer, payment gateways, etc.).
3.3. Shipping costs are borne by the Buyer according to the carrier’s rates.
3.4. The risk of loss or damage to the Goods transfers to the Buyer upon handing over to the delivery service.
4.1. The Buyer may return goods in proper condition within 14 calendar days from receipt, provided the goods are unused and original packaging is intact.
4.2. Returns apply only to shoes up to size 41 inclusive.
4.3. Shoes of size 42 or larger are deemed custom and are not eligible for return or exchange, except in case of manufacturing defect.
4.4. In case of defect, the Seller shall reimburse return shipping or replace the Goods.
4.5. Return shipping cost is non-refundable unless return is due to a defect or Seller’s error.
Seller’s obligations:
Provide information about Goods, pricing, and shipping terms;
Deliver Goods of acceptable quality;
Maintain confidentiality of Buyer’s personal data.
Buyer’s obligations:
Provide accurate data when placing an Order;
Pay and accept Goods in compliance with this Agreement;
Comply with all terms herein.
6.1. Parties bear liability under the laws of Ukraine.
6.2. The Seller is not liable for damage caused by improper use of the Goods.
6.3. In force majeure events (e.g. war, natural disaster), parties are released from liability for the duration of such events.
7.1. Personal data is collected, stored, and processed under the Ukrainian Law “On Personal Data Protection” and according to the Privacy Policy, which is integral part of this Agreement.
7.2. The Buyer grants consent to data processing for order fulfillment and related services.
8.1. Disputes to be resolved by negotiation.
8.2. If no agreement is reached, disputes submitted to courts in the Seller’s jurisdiction.
8.3. This Agreement is governed by Ukrainian law.
9.1. The Seller may amend this Agreement; changes do not affect already confirmed Orders.
9.2. Current version of the Agreement is published on zamkova-svitlana.com.
